§ 42-15. Variances.

  • Upon application for a variance and consideration of the application, and a determination that extraordinary hardship may result from strict compliance with the provisions of this chapter due to unusual topographic, health, public safety, or other conditions beyond the control of the applicant, the planning and zoning commission may vary the regulations so that substantial justice may be done and the public interest secured; provided, however, that such variation will not have the effect of nullifying the intent or purpose of this chapter.
